A former Missouri police officer has been charged with assaulting a man in his car

Joshua Smith, who worked for Florissant, Missouri, a police station, is facing first- and fourth-degree assault charges and armed criminal activity, the St. Petersburg prosecutor’s office said. Charles County Tim Lohmar on Wednesday.

The charges were filed after video surveillance was filmed by a surveillance camera of a resident recorded on June 2, prosecutors said. Smith was fired on June 10.

“As soon as the vehicle turned its headlights on the victim, it became a 4,000-pound rocket,” Lochmar told reporters.

Smith’s lawyer, Scott Rosenblum, told CNN that the video was a small part of the meeting “and does not tell the whole story” of the incident, which he called an accident “under exceptional circumstances”.

The officer was involved in the pursuit of a vehicle.

“We have a situation where the driver, after takeoff, jumped from a moving vehicle – allowing the vehicle to continue without permission,” Rosenblum wrote in an email. “Unexpectedly, the injured person also jumped out of the car. Mr. Smith never intended to hit him. Nor did he expect another passenger to jump in front of him from a moving car.”

The video from the scene shows the man being hit as he runs from a car as he slowly rolls down a road.

The fourth-degree attack comes from a former officer who kicked the victim while he was on the ground, already suffering from a broken ankle, Lochmar said.

According to a possible statement, Smith also hit the man before handcuffing him.

“It was shocking, to say the least,” Lohmar said of the video.

Jerryl Christmas, an unidentified injured person, told CNN, a subsidiary of KMOV, that his client “suffered serious injuries requiring surgery and remains injured from this shocking incident”.

Smith, who was with Florence police for nine years before being fired last week after a previous video was released, had security information due to “hints of looting and vandalism” following anti-racism protests in the area, Lochmar said. .

Smith, 31, and two other police officers in the SUV were following a car that matched the description of a car involved in an incident “shot” days earlier, Lochmar said.

The car did not take off immediately when Smith opened the siren and lights of the Ford Explorer, according to officials. Eventually, it stopped in a residential neighborhood as passengers got out and ran, Lochmar said. The victim was one of the three, according to Lohmar, he said.

Florissant is located north of St. Louis and near Ferguson, where 18-year-old Michael Brown was killed in a confrontation with police in 2014 that prompted the Black Lives Matter movement.
